New Mexico Opens Producer Permit Applications for Medical Psilocybin Program

New Mexico’s Department of Health began accepting producer permit applications for its Medical Psilocybin Program on August 17, 2026, as first reported by Source NM. The program was created by Senate Bill 219, the Medical Psilocybin Act, which was signed in April 2025.

Applicants must provide a state business license, proof of registration with the Secretary of State and the Taxation and Revenue Department, facility safety documents, proof of ownership or a landowner statement, proof of zoning compliance, and verification that products will be produced and tested only in New Mexico. A department spokesperson said there is no application deadline and applications are reviewed in the order received.

Rulemaking is not yet complete, and permit applications for testing laboratories and clinicians are expected to open later. The state has said it aims to admit first patients by the end of 2026, ahead of the act’s December 31, 2027 implementation deadline. Qualifying conditions include treatment-resistant depression, PTSD, substance use disorders and end-of-life care. The framework pairs patient access with state-regulated production, testing and clinician oversight.
